Alcance: Este Mandato regula actos de gestión operativa sobre medicamentos prescritos al MANDANTE. No transfiere propiedad de los medicamentos ni constituye relación laboral entre las partes. adhere actúa como agente autorizado, nunca como distribuidor farmacéutico ni como responsable de la prescripción médica. Scope: This Mandate governs acts of operational management over medications prescribed to the Principal. It does not transfer ownership of the medications, nor does it constitute an employment relationship between the parties. adhere acts as an authorized agent — never as a pharmaceutical distributor nor as the party responsible for the medical prescription.

1. Partes del Mandato1. Parties to the Mandate

Ancalofa SAS, directly or through its authorized pharmaceutical partners and logistics operators.	Plataforma digital de adherencia farmacéutica, operada como producto y servicio de Ancalofa SAS. Actúa como agente del MANDANTE en los actos descritos en las Cláusulas A a G. Digital medication-adherence platform, operated as a product and service of Ancalofa SAS. Acts as agent of the Principal in the acts described in Clauses A through G.

2. Objeto2. Purpose

El MANDANTE confiere al MANDATARIO un mandato especial, oneroso y revocable para gestionar, en su nombre y por su cuenta, los actos relacionados con sus prescripciones médicas y el acceso a los medicamentos recetados. Cada Cláusula es independiente — la revocación de una no afecta las demás.

The Principal grants the Agent a special, for-consideration, and revocable mandate to manage, in the Principal's name and on the Principal's behalf, the acts related to the Principal's medical prescriptions and access to prescribed medications. Each Clause is independent — revocation of one does not affect the others.

3. Actos Autorizados — Cláusulas A a G3. Authorized Acts — Clauses A through G

Cláusula AClause A Coordinación de Dispensación FarmacéuticaCoordination of Pharmaceutical Dispensing

El MANDANTE autoriza al MANDATARIO a coordinar, gestionar y hacer seguimiento al proceso de dispensación de sus medicamentos prescritos ante las farmacias, droguerías e IPS habilitadas por su EPS o asegurador, actuando como intermediario de comunicación y coordinación.

The Principal authorizes the Agent to coordinate, manage, and follow up on the dispensing process for the Principal's prescribed medications with the pharmacies, drugstores, and IPS (healthcare providers) authorized by the Principal's EPS or insurer, acting as an intermediary for communication and coordination.

El MANDATARIO podrá presentar, transmitir o gestionar la prescripción del MANDANTE ante el establecimiento farmacéutico designado, confirmar disponibilidad de medicamentos, recibir notificaciones de dispensación y coordinar el proceso de entrega.

The Agent may present, transmit, or manage the Principal's prescription with the designated pharmaceutical establishment, confirm medication availability, receive dispensing notifications, and coordinate the delivery process.

Alcance actual: Coordinación a través de la red de dispensación asignada por la EPS del MANDANTE. adhere no actúa como farmacia ni como dispensador.

Current scope: Coordination through the dispensing network assigned by the Principal's EPS. adhere does not act as a pharmacy or as a dispenser.

Alcance futuro: Esta cláusula cubrirá también la coordinación a través de aliados farmacéuticos autorizados de la red adhere, cuando dicha red sea habilitada.

Future scope: This Clause will also cover coordination through authorized pharmaceutical partners of the adhere network, once that network is enabled.

Cláusula BClause B Manejo, Almacenamiento, Reempaque y EntregaHandling, Storage, Repackaging, and Delivery

El MANDANTE autoriza al MANDATARIO y a los operadores logísticos que este designe, a recibir, manejar, almacenar temporalmente, reempacar en dosis unitarias o multidosis, y entregar en el domicilio o lugar indicado por el MANDANTE los medicamentos dispensados a su nombre.

The Principal authorizes the Agent, and the logistics operators the Agent designates, to receive, handle, temporarily store, repackage into unit-dose or multi-dose packaging, and deliver to the Principal's home or the location indicated by the Principal the medications dispensed in the Principal's name.

El reempaque se realizará únicamente cuando sea necesario para facilitar la adherencia del MANDANTE (por ejemplo, blíster unitario con identificación de dosis y horario) y no implicará modificación de la fórmula, concentración ni fecha de vencimiento. Todo manejo cumplirá las Buenas Prácticas de Almacenamiento y Distribución vigentes en Colombia.

Repackaging will be performed only when necessary to facilitate the Principal's adherence (for example, unit-dose blister packs labeled with dose and schedule) and will not involve any modification of the formula, concentration, or expiration date. All handling will comply with the Good Storage and Distribution Practices in force in Colombia.

Cláusula CClause C Adquisición en Nombre del PacienteProcurement on Behalf of the Patient

El MANDANTE autoriza al MANDATARIO a adquirir, en su nombre y con cargo a los medios de pago registrados en la plataforma, los medicamentos no cubiertos por su plan de beneficios en salud (PBS), incluyendo copagos, cuotas moderadoras, medicamentos no PBS y productos OTC incluidos en su plan de medicación.

The Principal authorizes the Agent to procure, in the Principal's name and charged to the payment methods registered on the platform, medications not covered by the Principal's health benefits plan (PBS), including copayments, moderating fees, non-PBS medications, and OTC products included in the Principal's medication plan.

Esta autorización se limita estrictamente a medicamentos vinculados a las prescripciones activas registradas en la cuenta del MANDANTE.

This authorization is strictly limited to medications linked to the active prescriptions registered in the Principal's account.

Esta cláusula aplica únicamente cuando el medicamento no sea cubierto total o parcialmente por la EPS. Para medicamentos PBS cubiertos al 100%, esta cláusula no opera.

This Clause applies only when the medication is not covered, in whole or in part, by the EPS. For PBS medications covered at 100%, this Clause does not apply.

Cláusula DClause D Retiro Físico de MedicamentosPhysical Pickup of Medications

El MANDANTE autoriza al MANDATARIO y a los mensajeros u operadores logísticos formalmente vinculados, a retirar físicamente en su nombre los medicamentos dispensados en las farmacias, droguerías o IPS correspondientes, previa presentación del número de prescripción o autorización electrónica.

The Principal authorizes the Agent, and the couriers or logistics operators formally engaged by the Agent, to physically pick up, in the Principal's name, the medications dispensed at the corresponding pharmacies, drugstores, or IPS, upon presentation of the prescription number or electronic authorization.

El MANDATARIO mantendrá un registro de cada retiro realizado (fecha, establecimiento, medicamentos retirados, operador), disponible para consulta del MANDANTE en la plataforma.

The Agent will keep a record of each pickup performed (date, establishment, medications collected, operator), available for the Principal to review on the platform.

Cláusula EClause E Acceso y Gestión de Prescripciones MIPRESAccess to and Management of MIPRES Prescriptions

El MANDANTE autoriza al MANDATARIO a acceder, consultar, gestionar y hacer seguimiento a sus prescripciones en el sistema MIPRES del Ministerio de Salud, cuando la integración técnica sea habilitada.

The Principal authorizes the Agent to access, consult, manage, and follow up on the Principal's prescriptions in the Ministry of Health's MIPRES system, once the technical integration is enabled.

Esta autorización incluye: consulta del estado de la prescripción, confirmación de dispensación pendiente, seguimiento de autorizaciones EPS y notificación al MANDANTE sobre cambios en su prescripción. El MANDATARIO no podrá modificar, anular ni emitir prescripciones en nombre del MANDANTE. El acceso es de lectura y coordinación únicamente.

This authorization includes: checking the status of the prescription, confirming pending dispensing, following up on EPS authorizations, and notifying the Principal of changes to the prescription. The Agent may not modify, cancel, or issue prescriptions on the Principal's behalf. Access is read-only and for coordination purposes only.

Cláusula FClause F Cadena de CustodiaChain of Custody

El MANDANTE acepta que el MANDATARIO mantenga un registro trazable de la cadena de custodia de sus medicamentos desde el retiro en el establecimiento farmacéutico hasta la entrega en el domicilio. La cadena incluye: nombre del operador, hora y lugar de retiro, condiciones de almacenamiento, hora y lugar de entrega, y nombre de quien recibe.

The Principal agrees that the Agent will maintain a traceable chain-of-custody record for the Principal's medications, from pickup at the pharmaceutical establishment through delivery at the home. The chain of custody includes: operator name, time and place of pickup, storage conditions, time and place of delivery, and the name of the person receiving the medications.

En caso de incidente durante el transporte (pérdida, daño, temperatura inadecuada), el MANDATARIO notificará al MANDANTE dentro de las 2 horas siguientes al evento y gestionará la reposición correspondiente.

In the event of an incident during transport (loss, damage, improper temperature), the Agent will notify the Principal within 2 hours of the event and will arrange for the corresponding replacement.

Cláusula GClause G Fraccionamiento de EntregasSplit Deliveries

El MANDANTE autoriza al MANDATARIO a fraccionar la entrega de sus medicamentos en múltiples despachos parciales cuando: (i) el establecimiento farmacéutico no cuente con disponibilidad completa del pedido, (ii) el MANDANTE lo solicite expresamente, o (iii) las condiciones logísticas o regulatorias así lo requieran.

The Principal authorizes the Agent to split delivery of the Principal's medications into multiple partial shipments when: (i) the pharmaceutical establishment does not have full availability of the order, (ii) the Principal expressly requests it, or (iii) logistical or regulatory conditions require it.

Cada entrega parcial será documentada con su registro de cadena de custodia. El fraccionamiento no genera costos adicionales para el MANDANTE salvo que este lo haya aceptado expresamente.

Each partial delivery will be documented with its own chain-of-custody record. Split delivery does not generate additional costs for the Principal unless the Principal has expressly accepted them.

4. Obligaciones del Mandatario4. Obligations of the Agent

Actuar siempre en nombre y beneficio del MANDANTE, sin desviarse de las instrucciones ni de los límites de cada Cláusula.
Always act in the name and for the benefit of the Principal, without deviating from the instructions or the limits of each Clause.
Rendir cuentas de cada acto ejecutado bajo este Mandato, con registro disponible en la plataforma.
Provide an accounting of every act performed under this Mandate, with a record available on the platform.
No delegar los actos autorizados en terceros no verificados. Los operadores logísticos deben estar formalmente vinculados al MANDATARIO.
Not delegate the authorized acts to unverified third parties. Logistics operators must be formally engaged by the Agent.
Garantizar confidencialidad de toda la información de salud del MANDANTE, conforme a la Política de Privacidad de adhere y la Ley 1581/2012.
Guarantee the confidentiality of all of the Principal's health information, in accordance with adhere's Privacy Policy and Ley 1581/2012.
Notificar de inmediato al MANDANTE cualquier incidente, irregularidad o imposibilidad de cumplimiento.
Immediately notify the Principal of any incident, irregularity, or inability to perform.
Conservar registros de todos los actos ejecutados por un mínimo de 5 años, conforme al Decreto 2200/2005.
Retain records of all acts performed for a minimum of 5 years, in accordance with Decreto 2200/2005.

5. Obligaciones del Mandante5. Obligations of the Principal

Mantener actualizada su información de salud, prescripciones activas y datos de contacto en adhere.
Keep their health information, active prescriptions, and contact details up to date in adhere.
Informar al MANDATARIO sobre cambios en su EPS, médico tratante o prescripciones activas que afecten este Mandato.
Inform the Agent of any changes to their EPS, treating physician, or active prescriptions that affect this Mandate.
Confirmar la recepción de los medicamentos entregados en los canales dispuestos por la plataforma.
Confirm receipt of delivered medications through the channels provided by the platform.
Notificar cualquier irregularidad en los medicamentos recibidos dentro de las 24 horas siguientes a la entrega.
Report any irregularity in the medications received within 24 hours of delivery.

6. Revocación y Vigencia6. Revocation and Term

Este Mandato es revocable en cualquier momento por el MANDANTE, sin necesidad de expresar causa, mediante notificación a info@ancalofa.com o a través de Ajustes > Privacidad y Datos > Revocar Mandato en la plataforma.

This Mandate is revocable at any time by the Principal, without the need to state a reason, by notifying info@ancalofa.com or through Settings > Privacy and Data > Revoke Mandate on the platform.

La revocación surte efecto dentro de las 24 horas siguientes a su recepción. Los actos ya ejecutados antes de la revocación conservan plena validez. La revocación del Mandato es independiente de la revocación del consentimiento de tratamiento de datos personales. Revocation takes effect within 24 hours of receipt. Acts already performed prior to revocation remain fully valid. Revocation of the Mandate is independent of revocation of consent for the processing of personal data.

7. Limitaciones del Mandato7. Limitations of the Mandate

Este Mandato NO autoriza al MANDATARIO a:

This Mandate does NOT authorize the Agent to:

Modificar, sustituir ni interrumpir prescripciones médicas.
Modify, substitute, or discontinue medical prescriptions.
Tomar decisiones clínicas o terapéuticas en nombre del MANDANTE.
Make clinical or therapeutic decisions on behalf of the Principal.
Adquirir medicamentos no relacionados con las prescripciones activas registradas.
Procure medications unrelated to the registered active prescriptions.
Compartir información de salud del MANDANTE con terceros no autorizados en la Política de Privacidad.
Share the Principal's health information with third parties not authorized under the Privacy Policy.
Actuar como distribuidor mayorista, como importador, ni como establecimiento farmacéutico habilitado por INVIMA en nombre propio.
Act as a wholesale distributor, an importer, or an INVIMA-licensed pharmaceutical establishment in its own name.

8. Aceptación Electrónica8. Electronic Acceptance

El MANDANTE declara que ha leído, comprendido y aceptado en su totalidad los términos del presente Mandato de Servicios Farmacéuticos.

The Principal declares that they have read, understood, and accepted in full the terms of this Pharmaceutical Services Mandate.

La aceptación electrónica mediante la plataforma adhere (marca de tiempo registrada en servidor) tiene la misma validez legal que la firma manuscrita, conforme a la Ley 527/1999 (Comercio Electrónico) y el Decreto 2364/2012 (Firma Electrónica).

Electronic acceptance through the adhere platform (server-recorded timestamp) has the same legal validity as a handwritten signature, in accordance with Ley 527/1999 (Electronic Commerce) and Decreto 2364/2012 (Electronic Signature).

Al aceptar, el MANDANTE confirma que actúa libre de presión, con plena capacidad legal, y puede revocar este Mandato en cualquier momento según la Sección 6.

By accepting, the Principal confirms that they act free of pressure, with full legal capacity, and may revoke this Mandate at any time as set out in Section 6.
